29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access: (a) Jobsite at 73 Warner Street in Newport, RI: On or about March 22, 2023, the employer did not ensure the use of a ladder, or other means of safe access, while employees worked on the third level of a scaffold (approximately 15 feet in height) to remove asbestos shingles from a residential roof, and thereby exposed employees to fall hazards when they climbed down through the inside of the scaffold. |

29 CFR 1926.1101(m)(2)(ii)(C): Medical examinations made available pursuant to 29 CFR 1926.1101(m)(2)(i)(A) through 29 CFR 1926.1101(m)(2)(i)(C) did not include a physical examination directed to the pulmonary and gastrointestinal systems, including a chest roentgenogram to be administered at the discretion of the physician, and pulmonary function tests of forced vital capacity (FVC) and forced expiratory volume at one second (FEV(1)).
