This complaint is in reference to my student loans and the current loan amount due.
I worked as a waitress when I graduated from high school in XX/XX/XXXX and went back to the XXXX XXXX in my state after 10 or more years after high school. I worked full time and attended school nights and earned an XXXX XXXX XXXX and acquired computer skills to apply for a secretarial job. I was encouraged to continue to transfer to a four year college and work towards a XXXX XXXX. At the time I had company reimbursed tuition. I was laid off at the company in XX/XX/XXXX and that is when I borrowed funds to continue my education. It took many more years to finally finish as I worked full time and encountered other company down sizing. I did not find a job right after finishing the four year degree in XX/XX/XXXXand that is when the loan balance grew to what is now an unmanageable debt. I originally borrowed $ XXXX and now owe over $ 90K. A regular payment is {$880.00} which is more than my mortgage and currently on an income based payment which is {$420.00} or so per month.
This payment structure is interest only and will never in this life time pay this off. I need assistance in being put in harms way due to higher inflationary interest charges at a vulnerable time. This loan is structured to be in forebearance and accrue high interest for a chance to develop experience to apply for a higher paying job.

In the past I have written to XXXX XXXX, XXXX XXXX, Department of Education, and the XXXX XXXX XXXX. In all my efforts to obtain resolution I have failed. I borrowed roughly {$10000.00} in XXXX loans from XXXX. I did rehabilitate my loans and have been paying for 28 years now. I have paid already more than {$28000.00}. I am almost finished. Yet, I am not finished with the fight. I was an incarcerated individual for a period exceeding 10 years. During that time I was sent many many bills from Sallie Mae which is now Navient. Though I was pushed into forbearance and financial hardship conditions, never was I told that I couldve applied for public service loan forgiveness as I was incarcerated and working the entire time. It would have been an impossibility to make payments and continue correspondence with the company. During incarceration there a long stretches where an individual makes anywhere from $ XXXX {$.00} an hour. It would take months just to buy a book of stamps. Though my life has completely changed and I have achieved a successful status Im still facing debt with the embattled Navient company. On the Internet I found terms that state, from federal student loan.org-the government will write off loans if the borrower is to be incarcerated for a period exceeding 10 years and the debts can be reinstated when the individual is released. I was never informed of this condition and my loans were sold from company to company before landing with Navient. I watched the interest to get capitalized and fees accrue while I remained helpless. I am confident there is more than just me that face this. And, it is an incredible burden to be faced with as soon as you step out of a long-term incarceration. I should like to see this group of people get some resolution where college debt is concerned. Currently, there is much talk about loan forgiveness and pause in payments, but no one talks about those who have paid the price and changed their lives. It has been personally, as if I am being punished forever and I dont think thats fair. Im confident that I am not alone. And I am also confident that no one has yet addressed this group of indebted folks. I borrowed money starting 15 or more years ago to attend the XXXX College of XXXX XXXX and transferred to XXXX College to pursue a XXXX XXXX. I became unemployed in XX/XX/XXXX resumed the effort to finish my XXXX XXXX and that is when I borrowed the funds to finish the degree. I was XXXX years old and unemployed and felt this was my best opportunity to keep myself employed and able to pay my bills. I graduated in XX/XX/XXXX but remained working temporary jobs and or permanent jobs as an XXXX XXXX and also experienced layoffs and down sizing making it very difficult to pay the student loan bills. I was offered deferments and forbearances that only increased the loan debt to an incredibly high loan amount that I find impossible to pay. I was never offered an affordable payment until the loan balance more than tripled and now Navient is saying I have to pay 10 % of my earnings. At age XXXX this has caused a financial burden, reputational harm and much stress and XXXX of how this is going to affect the rest of my life. I in good faith went to school with the promise and chance for a better opportunities for employment and not rely on state aid. I was never offered an income based payment option and have attached my social security wages from my entire working history to show I really have not had sufficient income to pay these loans. I still live paycheck to paycheck and will never get this debt paid in my lifetime. I believe this to be predatory lending, unfair lending practice and this loan structure has caused intentional harm to my livelihood and any future financial security. I need assistance in having this loan reduced to the original loan amount and credit for the years I have tried to pay this off. This financial burden has been nothing but a nightmare. I went to school part time for over 13 years while working full time part time and many times two jobs and keeping up with class work. The financial aid at the school processed all the paperwork with the FAFSA form and each year even the bill for the minimum of six credits was several thousand dollars. I need assistance with this as I am overwhelmed with high payments and financial consequences for the rest of my life. I have attached what I paid last year which is about {$2000.00} and yet these loans are not in good standing and adversely affect my credit score once again. All of my credit is in good standing except this and I need assistance in getting this loan amount to one that is within the original amount and therefore affordable. I need help as these are not affordable on my week to week paycheck. Please provide me with some assistance.

The XXXX XXXX was started XX/XX/XXXX for {$10000.00}. It has been sold at least twice. I and my co-signer have paid in {$9200.00}. I went into bankruptcy from XX/XX/XXXX to XX/XX/XXXX.
The loan is now with Navient.. This is a private loan. Navient has accrued the interest during bankruptcy and applied {$640.00} from the bankruptcy administrator toward interest while the court shows principal payments.
This XX/XX/XXXX ( XX/XX/XXXX ) Navient advised me to take a forbearance and capitalized interest and fees and I paid them {$50.00} to do this. The terms were to start payments XX/XX/XXXX. This agreement was taped., now they say that I missed XX/XX/XXXX and they say I owe an XX/XX/XXXX payment plus a late fee.
This loan has been handled this way throughout, selling the loan, advising forbearance and capitalizing interest.
To sum up, after 13 years, paying in {$9200.00}, and a bankruptcy the PRINCIPAL IS {$10000.00} OR {$440.00} LESS THAN THE ORIGINAL PROCEEDS.

My loan balance grows each time I log into the website and check the balance. I do n't understand why the loan balance grows if the interest due is paid with each monthly payment. If the loan balance is growing then my student loan is a negative amortization loan which does n't make sense as these are fixed rate loans and I have a set 10 year term. In addition, each month since I entered repayment I have paid extra toward the principal. I always select the option " I want to make my next scheduled payment ''. I never elect for the overpayment to advance my due date since I always want the overpayments to go directly to my principal balance. Navient always skips my payments on the loans that I overpay. For example, if I have 4 loans and overpay 1 I only receive payment notices on the remaining 3 loans. Navient is not following my direction and instead isapplying my overpayments so it advances my due dates. I would like the following to happen if possible : Can my loan balances be audited to find out why my loan balances keep growing and to find out why Navient is applying my overpayments to my future payments rather than my principal balance?

Hello, On XXXX / XXXX / XXXX , I was trying to settle my charged-off student loans with Navient ( formerly XXXX XXXX ). Because the of the account status, Navient would not speak to me directly and my calls were automatically forwarded to XXXX XXXX XXXX ( XXXX ), their third party debt collection agency. On that date, they offered me a {$18000.00} cash settlement to close out the account, which I was unable to pay so they agreed to monthly payments in the amount of {$250.00}. On XXXX / XXXX / XXXX , after making all my payments on time, every month, with no issue, I had saved enough to settle the rest of the account and called XXXX . I spoke with XXXX XXXX , a manager, who assured me that if I paid the {$14000.00} that my account would have a {$0.00} balance and Navient would update my credit reports. So I paid the {$14000.00} and was provided a reference number of XXXX . I received the settlement offer and a {$0.00} balance letter in writing showing that my account was settled in full. I let a couple months go by and my reports are still not updated. I submitted disputes to all XXXX credit bureaus on XXXX / XXXX / XXXX and it 's still showing that my account is charged-off, with an open balance, a past due amount and payment terms after the investigations were completed. This is not right. I settled these accounts so I could improve my creditworthiness and now it 's almost as if I never made the payment. I even had XXXX re-report that the accounts were 120 days past due on XXXX / XXXX / XXXX when I had already settled the account 45 days earlier. Can you please help? I do n't know what is happening. XXXX had to get approval from Navient to settle on the account so I do n't understand why they are not updating all of my reports. I 'm attaching the settlement offer as well as the {$0.00} balance letter for your review.

My student loan company, Navient, has been recently increasing my interest rates significantly, consequently preventing me to pay off my loans. I have asked them multiple times over the years to help me with consolidation or to stop increasing interest rates considering I make timely monthly payments every time, and time after time I am being declined their support. In preparation for a mortgage, I requested a schedule of payments- how much I owe on each due date going forward on the loan. They told me they were unable to provide me with this information, as it depended on how much I paid each month. My amount due has n't changed in months, and I pay the same, consistent amount. They were able to tell me approximately what my loan schedule would be, but could n't send something in writing. I have both federal and private student loans -- all handled by Navient. When I pay my federal loans, I often make an overpayment for one of the loans online. When you overpay on a federal loan, the computer system asks how you would prefer the extra payment ( if it 's greater than 100 % of the amount due, i.e. if the payment is {$25.00} and you make a {$26.00} payment ). You can either 1 ) extend the due date of the loan or 2 ) make your next payment on time, which means the overpayment is applied to the principal of the loan. This is a great way for people to tackle their loans and decrease the life of the loan overall. When overpaying a private loan, you CAN choose to have the payment applied to the principal by NOT extending the due date, though you have to send in a physical check with a piece of paper detailing how you would like the payment applied. When you attempt to overpay your private loans online, the system ONLY gives you the option of extending the due date, meaning that the additional payment is applied to the bundled interest-principal payment. Not allowing borrowers to apply overpayments towards the principal line ( like one can when overpaying on federal loans ) makes it more difficult for borrowers to more quickly pay off their loans - extending the life of the loan and the amount of interest that borrow is playing.
Navient should allow borrowers to make overpayments for their private loans and apply those overpayments to the principal by not extending the due date of their payment.

Complaint What Happened |
It 's disappointing to see the government complete business with an organization that has these alleged complaints. The ambitions of individuals pursuing educational opportunities is being toyed with by an organization that seeks greed. I 've paid close attention to my student loan account with regard to processing payment times, and also how the company did not return calls that I 've made to ask questions. Basically I 've seen the account holder take 3,4,5 business days to process payments I 've made on my loans. Meanwhile, more interest accrued on the principle that subsequently led to a higher repayment amount. Unfortunately I can not total all the extra cash that has been taken from my wallet because of the delayed processing times.The irony with this whole navient lawsuit coming out is that all the issues that I 've experienced with the company were resolved less than 24 hours after the story broke on national news. Processing payment times have reduced from the 3,4,5 days to 1-2 days maximum. Best thing, in a short while I will have my 30 year loan paid in 4-5 years and I will not have to do business with a company that reminds me of certain other companies that have sought excessive financial gain on unsuspecting consumers.
