29 CFR 1926.62(d)(2)(v): Until the employer performed an employee exposure assessment as required under paragraph (d) of this section and determined actual employee exposure, the employer did not provide to employees performing the tasks described in paragraphs (d)(2)(i), (d)(2)(ii), (d)(2)(iii) and (d)(2)(iv) of this section with interim protection as follows: (A): Appropriate respiratory protection in accordance with paragraph (f) of this section. (B): Appropriate personal protective clothing and equipment in accordance with paragraph (g) of this section. (C): Change areas in accordance with paragraph (i)(2) of this section. (D): Hand washing facilities in accordance with paragraph (i)(5) of this section. (E): Biological monitoring in accordance with paragraph (j)(1)(i) of this section, to consist of blood sampling and analysis for lead and zinc protoporphyrin levels, and (F): Training as required under paragraph (l)(1)(i) of this section regarding 29 CFR 1926.59, Hazard Communication; training as required under paragraph (1)(2)(iii) of this section, regarding use of respirators; and training in accordance with 29 CFR 1926.21, Safety training and education. Worksite: When employees were abrasively disturbing Lead-based paint, the employer did not provide adequate interim protection as outlined in 29CFR 1926.62(d)(2)(v)(A) through (F). |

29 CFR 1926.1101(g)(1):The employer did not use the following engineering controls and work practices in all operations covered by this section, regardless of the levels of exposure: (i): Vacuum cleaners equipped with HEPA filters to collect all debris and dust containing ACM and PACM, except as provided in paragraph (g)(8)(ii) of this section in the case of roofing material; (ii): Wet methods, or wetting agents, to control employee exposures during asbestos handling, mixing, removal, cutting, application, and cleanup, except where employers demonstrate that the use of wet methods is infeasible due to for example, the creation of electrical hazards, equipment malfunction, and, in roofing, except as provide in paragraph (g)(8)(ii) of this section; and (iii): Prompt clean-up and disposal of wastes and debris contaminated with asbestos in leak-tight containers except in roofing operations, where the procedures specified in paragraph (g)(8)(ii) of this section apply: Worksite: When employees were assigned to abrasively remove asbestos-containing siding material, the employer did not use the engineering and work practice controls outlined in 29 CFR 1926.1101(g)(i) through (iii). |
