We noticed in XX/XX/XXXX, that our XXXX account got charged the wrong amount. We contacted our Mortgage Company, Lakeview Loan Servicing/XXXX XXXX XXXX XXXX right away via their website and they never responded. We ended up calling on XXXX, XXXX XXXX, via customer phone service and the customer service representative we spoke to promised us that this mistake will get fixed ASAP, but nothing got done.
We did go to the City to make sure both our lot and house taxes got paid on time with the correct amount. They confirmed that they got the right amount for each lot. A one time payment of {$97.00} for the lot XXXX. And 4 times {$710.00} on the lot XXXX.
Lakeview Loan ServicingXXXX XXXX XXXX took out of our escrow, XXXX payments of {$97.00} for the lot XXXX. In which the city only got a XXXX time payment of {$97.00}. Lakeview Loan ServicingXXXX XXXX XXXX also took one extra payment of {$710.00} on the same lot XXXX. Lakeview Loan ServicingXXXX XXXX XXXX took out of our escrow, totalling {$910.00} which is unaccounted for.
On XXXX, XXXX XXXX, we reveiced our yearly Escrow Analysis and we noticed the previous mistake was never fixed and of course our Escrow ended up being short because of it. We called Lakeview Loan ServicingXXXX XXXX XXXX again on XXXX, XXXX XXXX and the customer service agent was rude and not cooperating with us. After this incident we decided on XXXX, XXXX XXXX to send them a registered letter, Notice of Error, stating to the company what needs to be fixed and and as of today, XX/XX/XXXX, we reveiced no communication nor cooperation from Lakeview Loan ServicingXXXXXXXX XXXX XXXX and our mortage increased and nothing got resolved. We gave them the required amount of time, the 30 days, to respond back to us by law.
We ask that you look into this matter so this escrow issue can be fixed ASAP. Also so we can find out where our {$910.00} went.

My fiance XXXX XXXX and I have a mortgage with Lakeview loan number XXXX. In XX/XX/2022, we received a notice from Lakeview that our taxes were not paid and they were increasing our mortgage payment to compensate to pay the back taxes owed. When we looked on the Lakeview portal we could see our quarterly tax disbursements for the following amounts : XX/XX/2022 XXXX, XX/XX/2022 XXXX, XX/XX/2022 XXXX, XX/XX/XXXX XXXX XXXX, and XX/XX/2022 XXXX. But despite these payments being made, Lakeview forced us to pay almost XXXX extra each month for several months. I filed a complaint with the XXXX and CFPB and this pushed Lakeview to research the issue. XXXX and I researched on our end with our closing attorney. It appeared that the taxes were being paid on our condo association and NOT on our condo unit. As such, after the two regulator complaints were filed, Lakeview contacted us and advised an overage of approximately XXXX was due to us and we were sent a refund. Now, a few weeks ago, we received notification from Lakeviews servicer XXXX that we owe XXXX which is the exact amount of the 5 quarterly disbursements made on our account. Again, it appears that they never corrected the tax amount that was misapplied. Dealing with Lakeview and XXXX is a complete nightmare. I also tried to reconcile the amounts using the payments made on the Lakeview website under our loan account but its impossible to do so with the way they reported our payments. I also asked Lakeview to perform an audit on our account to ensure everything was corrected but they failed to do so. Please address this issue as we will never get this resolved with them unless we double pay them another XXXX when we already paid the taxes owed on our property.

Hello, On XX/XX/year> LoanCare received a Qualified written request from the consumer requesting the following information : 1 ) Mortgage Insurance Policy for Account ending in XXXX.
2 ) Title Insurance Policy for Account ending in XXXX.
3 ) Escrow Accounting.
The mortgage servicer is in violation of RESPA 12 CFR 104.35 and 1024.36, which states that the servicer has 5 days to acknowledge the receipt of the qualified written request and 30 days to answer the request. I has been longer than 30 days and the servicer has not responded to the request.
These violations have caused the consumer significant financial harm and stress. The consumer have attempted to resolve these issues amicably through previous communications, but has not received a satisfactory response.

I recently closed on my home on XX/XX/XXXX. My mortgage then changed hands and is serviced by Lakeview Loan Servicing , LLC. My payment includes taxes and insurance however I applied for the XXXX XXXX with my city, which was approved. Once I received the updated tax statement I faxed it to Lakeview Loan Servicing , LLC and requested them to confirm with me upon receipt. I never heard back. I sent an email and I have tried AT MINIMUM four times to reach customer service about my escrow account via phone ... their recording would say they had a high call volume and to leave a call back number. I have done this THREE times. I received a call back over a week after my initial request ... Though I am not sure if my email to customer service or my request for them to call me triggered the call back. Regardless, whomever I spoke with told me that my account would be updated by XX/XX/XXXX. It is now XX/XX/XXXX and YET AGAIN I have not heard back and my payment amount has not been updated. I sent ANOTHER email on XX/XX/XXXX and have not heard back from that request either. I find the lack of customer service to be unacceptable. The ONLY way I was able to talk to someone was when I opted to speak with someone about my insurance, because this company also had an error with my insurance information ( no fault of mine as I have had coverage and its paid for with my mortgage payment ). After I resolved the insurance information I asked the woman to connect me to customer service because I am not able to reach them, she said she would stay on the line but then transferred me to another recorded line instead which eventually hung up on me. Being unable to reach my mortgage and have my payment adjusted down to where it should be is not acceptable. They also now will need to back date and update the additional payment amount to principal however I can not get ahold of them in a timely manner, they have left me with no choice but to write this complaint in the hopes to get this matter resolved.

In XXXX we refinanced our home and ended up with Lakeview Loan Servicing LLC. Their headquarters are located at XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX
Then in XXXX I noticed that our escrow was calculated wrong.
We own a lot that had a one time tax of {$97.00} and then the house taxes were 4 times {$710.00}. I realize that wasnt then numbers on the statement online at the website of Lakeview Loan Servicing LLC. So immediately connected with Lakeview for them to fix our escrow issue. Unfortunately, they dismissed me multiple times. I ended up sending a Notice of Error with registered mail and again had no response. Then in XX/XX/XXXX I received our new escrow analysis and due to their error we are {$2800.00} short! I understand that our taxes and insurance have increased but according to that we would only have a {$33.00} increase a month on the mortgage, not a {$440.00} increase!
I decided because Lakeview wasnt responsive then file complaints with various agencies. The OCC, XXXX and AGs office. None of them were of any help, except the XXXX. The XXXX was the only agency that got Lakeview to respond back and to admit that they made an accounting mistake on their part, but they are not willing to credit us the full amount. They calculated/projected on paper 4 times the lot taxes of {$97.00} and only calculated/projected the house tax one time {$710.00}. But again are only willing to credit us with {$1400.00} not the entire amount of {$2800.00}. Right after the XXXX decided to close this complaint. What is absolutely nonsense, because we rejected the offer because they are willing to only credit us half of what they own us. What is fraudulent.
We did go and check with the City of XXXX and they did say they received the correct amount from Lakeview the one time {$97.00} and 4 times {$710.00}. but again, on paper they calculated/ projected it wrong and it made our escrow short. I ask that the other half {$1400.00} gets credited ASAP, and that there will be a full investigation into Lakeview Loan Servicing LLC, and all other affiliates with them. To not be willing to credit us with the right amount due to their negligence is fraudulent.
This company has unethical business practices and are doing this, I am pretty sure knowingly.

On XX/XX/XXXX, the XXXX XXXX XXXX XXXX XXXX tax collector sent a letter informing my fiance and I that we had an outstanding balance owed on our XXXX real estate taxes. We had refinanced our previous mortgage XX/XX/XXXX and verified with the closing agent that they had appropriately applied escrow funds for taxes owed. At the time of receiving the letter, I attempted multiple times to resolve the escrow shortage with the Lakeview loan servicer, XXXX. In addition, the insurance broker I have used for years attempted to call them for the hazard insurance. When the broker called, XXXX stated they had no record of my loan. During my attempts to resolve, they would claim to research and call me back but never did and now 7 months later I can not resolve this issue. By reviewing the payments on the Lakeview loan servicing website, I can see funds posting as XXXX XXXX and XXXX XXXX XXXX XXXX. However, the amount listed {$2600.00} is not our quarterly escrow amount. It should be {$2200.00}. I have asked for copies of checks and evidence of where the funds were sent to. If we can obtain this, we can see where these funds were applied to. We were informed by the XXXX XXXX XXXX XXXX XXXX XXXXXXXX collector that the amount {$2600.00} does appear to be the amount owed for our condo association builder ( XXXX XXXX XXXXXXXX XXXX ). But we can't get XXXX to work with us or provide the documentation needed to resolve this. My fiance had posted a poor review on the XXXX XXXX XXXX and Lakeview reached out to state they are opening a case but passed it back to loan servicer XXXX. We do not want this issue to continue being unresolved. Our escrow balance went into a shortage, our taxes are not paid, and our mortgage payment increased to account for a shortage created by XXXX in the first place.

The taxes on my property were not paid by the mortgage company for several quarters beginning in XX/XX/ 2020, as a result, my account became delinquent and penalties were added. I contact the mortgage company Lakeview Loan Servicing, and spoke to Ms. XXXX and was directed to email her at XXXX. Afterwards I was directed to contact XXXX and start a complaint process. Over the course of the next 8 months I contacted thirdparty on numerous occasions and never heard back. In XX/XX/2020 I refinanced the property, at which time I explained the issue to my closing attorney. He sent out a certified letter requesting a response from the company, at which time they did not respond to his request. I pay my mortgage on time every time, and have never been past due. I don't understand why my taxes weren't paid and allowed them to be delinquent. In addition, their lack of professionalism has left me with no other choice but to file a formal complaint.

I received a letter from my tax office in XX/XX/2020 stating there was a delinquent balance on my real estate taxes of {$2800.00}. The taxes are included in my mortgage payment in escrow. I immediately contacted my mortgage company and emailed them the letter. They assured me they would look into the problem and resolve the problem. A few weeks later I received another letter from the tax office indicating a tax sale is scheduled for XXXX. I called again on XX/XX/XXXX, told them about the second letter and emailed that one as well. I was told, yet again, the problem would be resolved by XX/XX/XXXX. On XX/XX/XXXX, I called the tax office to confirm that the mortgage company had taken care of the delinquent payments only to be informed they had not and my balance was now {$3900.00}. I again called them and asked to speak with a manager who informed me the only thing she could do was expedite my case and it should be taken care in 3-4 business days. When asked why the payments weren't being made her response was, " I don't know, I can't answer that. '' In the meantime, a tax sale situation is taking place and the tax office is not concerned that this isn't my fault, they are just concerned about getting the balance owed. I pay my mortgage every month on time and this is unacceptable and negligent action on behalf of the mortgage company.

I had a mortgage with Lakeview Loan Servicing LLC that was transferred to XXXX XXXX XXXX XXXX effective XX/XX/XXXX. In reviewing my payment history, I noticed there were two " Escrow to Borrower Refunds, '' one on XX/XX/XXXX and another on XX/XX/XXXX, for which I have no record of having received. The amount of these disbursements was {$1900.00} and {$1400.00} ( see Attached Payment History ). I am not disputing whether these escrow amounts were disbursed to me, rather, I don't have any check stubs nor bank records that indicated that I cashed or deposited the escrow disbursements. So, I requested information on how these escrow refunds were disbursed. Following is a chronology of my attempts to get that information : XX/XX/XXXX email to XXXX ( a.k.a. XXXX ) inquiring how the subject escrow refunds as well as another escrow refund in the amount of {$110.00} were disbursed.
XX/XX/XXXX email from XXXX ( Attachment A ) indicating that an escrow check in the amount of {$110.00} was sent on XX/XX/XXXX. The email did respond to the other escrow refunds.
XX/XX/XXXX email to XXXX inquiring What about the rest of my question? What happened to the other escrow refunds?
XX/XX/XXXX email from XXXX ( Attachment B ) responding as follows : We have received your inquiry and are assigning it to the proper department representative. Please note duplicate inquiries may prolong your time for resolution. To help identify your inquiry we have generated a reference/ticket number. Your reference/ticket number is XXXX. Please use this number in any further communication relating to your recently submitted email request. Please allow 5 business days for a thorough review and research of your inquiry.
XX/XX/XXXX email to XXXX requesting copies of cancelled escrow refund checks to document that it was refunded to me.
XX/XX/XXXX email from XXXX ( Attachment C ) responding as follows : We have received your recent inquiry in regards to your mortgage account. Your request has been forwarded to our escrow department for further review. Please DO NOT REPLY to this email. Your request has been marked resolved and this ticket has been CLOSED. Replies to this resolved ticket will not be monitored. If you need further assistance or have additional questions, please submit a new request by visiting our website and logging into your account. Please feel free to contact us if you have any additional questions.
XX/XX/XXXX, after no further response from XXXX, I sent a letter ( Attachment D ) to Lakeview Loan Servicing Mortgage Resolution requesting copies of cancelled escrow refund checks to document the " escrow refund to burrower '' amounts ( i.e., {$1900.00} and {$1400.00} ).
Thirty ( 30 ) days have passed and XXXX has not acknowledged my letter nor either provided the requested information, determined that the requested information is not available, or asked for additional information or requested additional time to investigate my request, Therefore, I am submitting this complaint in hopes that Consumer Financial Protection Bureau can help me to get the requested information from XXXX.

This year I was in the process of transitioning all of my bank accounts from XXXX XXXX XXXX in North Dakota to a XXXX in Rhode Island. During that time I successfully transitioned all of my payroll and auto bill pay processes to the new bank account, expect for one : a home mortgage that is managed by Lakeview Loan Servicing.
While changing the bank information for my mortgage autopay on the Lakeview Loan Servicing website I inadvertently input the wrong bank account number into the websites field requiring bank information. Due to this error, my mortgage was not paid during the month of XXXX. After learning about this, I navigated to the Lakeview Loan Servicing website to attempt to make a manual payment, which I did. However, I was still unaware that my bank account information was erroneously entered on the website. I did not receive communication, either via postal mail or via email, from Lakeview Loan Servicing that my payments were unsuccessful.
In XXXX I re-reviewed my bank statement and learned that my mortgage payment was not submitted. That is when I learned that my bank account information was erroneously added to my account. That is why on XX/XX/XXXX I called Lakeview Loan Servicing to work with the servicer to resolve my situation. On that date I made my XX/XX/year> mortgage payment. The customer service representative informed me to call back on XX/XX/XXXX to make the second mortgage payment.
After contacting the servicer to make this second payment I was informed that I am not allowed to make a payment online because my previously attempted payments were not successful. Instead, I am required to submit a payment via XXXX XXXX for XXXX consecutive months. The Lakeview Loan Servicing website does not feature instructions for making these payments. When I asked a customer service representative to email me the instructions, I was informed that it was not possible to do so.

Complaint What Happened |
On 5/16 Lakeview LLC and Parent Company XXXX XXXX received a Debt validation and verification request from the consumer. The consumer believes that Lakeview is using false, deceptive, or misleading practices trying to enforce the alleged debt. Therefore, I ( the consumer ) am disputing the alleged debt and request that Lakeview provide the following information pursuant 15 U.S. Code 1692-1692p most commonly known as, and thereinafter, " The Fair Debt Collection Practices Act ( FDCPA ). '' Definitions pursuant 15 U.S. Code 1692 : ( 1 ) The term consumer means any natural person obligated or allegedly obligated to pay any debt.
( 2 ) The term creditor means any person who offers or extends credit creating a debt or to whom a debt is owed, but such term does not include any person to the extent that he receives an assignment or transfer of a debt in default solely for the purpose of facilitating collection of such debt for another.
The consumer disputes this debt in its entirety. Pursuant 15 U.S. Code 1692g, the consumer requests : 1 ) the name and address of the ORIGINAL CREDITOR ( See definition above ), therefore, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or a copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment.
Verification is defined as : confirmation of correctness, truth, or authenticity by affidavit, oath, or deposition ( XXXX XXXX XXXX XXXX XXXX XXXX XXXX ).
Judgment is defined as : The official and authentic decision of a court of justice upon the respective rights and claims of the parties to an action or suit therein litigated and submitted to its determination. The final decision of the court resolving the dispute and determining the rights and obligations of the parties. The law 's last word in a judicial controversy. ( XXXX 's XXXX XXXX, XXXX XXXXXXXX XXXX XXXX ).
I request that Lakeview LLC and Parent company XXXX XXXX obtain verification of the debt or a copy of a judgment, according to the definitions above, of the name and address of the ORIGINAL CREDITOR.
This is the consumer 's good faith attempt to resolve this issue that has caused the consumer emotional distress, mental distress, and monetary loss up to {$490000.00} due to the threat of foreclosure.
