Citation text line 29 CFR 1915.13(b)(4): Testing was not conducted by the competent person as often as necessary during cleaning or cold work to assure that air concentrations were below 10 percent of the lower explosive limit and within the PELs and below IDLH levels. Factors such as, but not limited to, temperature, volatility of the residues and other existing conditions in and about the spaces are to be considered in determining the frequency of testing necessary to assure a safe atmosphere: Worksite: The employer did not ensure that testing for flammable solvent vapors was conducted by a competent person as often as necessary during painting activities to assure that air concentrations were below 10 percent of the lower explosive limit and within PELs and IDLH levels. The employee who performed the testing activities tested just inside the main entry hatch and not below deck where the painting activities were being conducted.

Citation text line 29 CFR 1915.13(b)(11): All air moving equipment and its component parts, including duct work, capable of generating a static electric discharge of sufficient energy to create a source of ignition, were not bonded electrically to the structure of a vessel or vessel section or, in the case of land-side spaces, grounded to prevent an electric discharge in the space: Worksite: When Painters were applying flammable coatings to a vessel below decks, the employer used an electrically-powered ventilation unit to supply clean air to these workers. This ventilation unit was not adequately grounded to the vessel during these operations. This exposed the Painters to fire and explosion hazards.
