Complaint What Happened I have initiated an investigation into a fraudulent student loan taken out under my name and have given Sallie Mae/XXXX enough information as well as new information to come to the obvious conclusion that this loan was taken out without my knowledge or consent ; that the body of the loan belonged to my late father XXXX XXXX. I did defer the loan more than once and contacted an attorney to devise a course of action. A letter was sent by XXXX XXXX XXXX who is a Elder Law/Estate Attorney in RI and has worked on my late father 's estate and under the advice of the Executor XXXX XXXX XXXX that this loan was taken out without my knowledge. In good faith, I did pay some of the loan because I was advised by said attorney to do so. XXXX XXXX ONLY wrote XXXX letter and made XXXX phone call to the XXXX XXXX XXXX office, in which they told him that because the name matches the borrower, then the loan belonged to me. XXXX XXXX has been released. My mother XXXX XXXX XXXX XXXX and I called the Sallie Mae office. The representatives stated that they could no longer speak to me because I had representation and gave me a phone number for said attorney that does n't exist. ( XXXX ) I filed a complaint with the FTC, the Department of Education and the XXXX Police because my Identity was stolen by my father and documents were falsified to obtain money to pay for my education. Furthermore, I have also been referenced as a mortgage holder by the Law Firm XXXX XXXX XXXX now know as XXXX XXXX XXXX being addressed to The Spouse of XXXX XXXX ''. This letter was in reference to the foreclosure of the property XXXX my former home ) XXXX XXXX XXXX, XXXX RI, which I have no legal link. However, I was referenced on the Sallie Mae loan as being married under my information and that any additional income was from my spouse. I am not married and never have been married. The additional income is in reference to my late fathers wife XXXX XXXX XXXX and again, she is also the Executor of his estate. There is no other link to my being referenced as " married '' but in the body of the Sallie Mae/Navient loan. Pay stubs have been submitted showing and will prove that I never worked at XXXX XXXX in XXXX, and never made {$100000.00}. In addition I will enclosed proof that my late father worked for XXXX XXXX and never worked for a company listed as XXXX XXXX. My father referenced myself as being married and not he. Also enclosed was a letter from XXXX XXXX XXXX my XXXX XXXX which states that she also never knew about this loan and was listed in the loan as a reference. I was informed from a Sallie MaeXXXX XXXX representative, XXXX XXXX that the burden of proof that I didnt know was on me. However, considering that this document was obviously falsified ( which is a crime ) and that Sallie MaeXXXX approved a loan that was obviously false leads me to believe that the burden falls on Sallie MaeXXXX to prove that I did know about where the funds for my education came from. That Sallie Mae/XXXX approved on their own an obvious illegal document. My late father XXXX XXXX took care of the finances and so did his wife XXXX XXXX XXXX because she co-signed a loan from XXXX XXXX. I was told before my father passed that I was responsible for ONLY the payment on the last semester of my time at XXXX XXXX and XXXX other loan which XXXX XXXX co signed and I have done so. Based on my investigation, I have advised Sallie MaeXXXX that this loan was applied for by my late father, XXXX XXXX XXXX and because of Sallie MaeXXXX XXXX XXXX rules he put me down as the borrower, there was no other option. This loan was obviously his. At this point in time, Sallie MaeXXXX has failed to filed a claim against my late father 's estate ( which is still open ), they also insisted after the XXXX day time frame ( when we called again ) that a letter was sent to the XXXX XXXX of XXXX XXXX of RI regarding the response to our opposition. In the body of the original document sent, we stated that the attorney was released. I have yet to get a confirmation that that was the case because the attorney refuses to acknowledge that he received the letter. My XXXX XXXX has been adversely effected after I spoke to the Sallie Mae/XXXX representatives and I was told that a freeze was to occur until the investigation was concluded. They keep emailing me stating that I 'm missing payments. All three credit bureau have been notified of the situation ( and will be notified again XXXX. Sallie Mae received an email from XXXX or more reporting agencies that the stated loan is not mine. As I have stated before, I have sent Sallie Mae/XXXX additional documents to prove this to be the case. In conclusion, I need Sallie Mae to admit negligence, that they approved a fraudulent and illegal document willingly, that they reverse any disparing marks on my credit reports, that they acknowledge that although the money went to my education, the true owner was my late father ( he insisted that I be kept out of the details of my education 's funding ) and because he passed, it should be forgiven. I am also insisting that monies sent to Sallie Mae/XXXX be refunded and that they file for damages against the estate of XXXX XXXX through the XXXX. I can not be held accountable for the actions of my late father.

Complaint What Happened I am the cosigner for private student loans taken out with Sallie Mae ( Navient ) and XXXX ( serviced by XXXX ). XXXX was sued by the MA Attorney General and closed down because of predatory lending practices and misleading students. My daughter submitted a Borrower 's Defense to Repayment App for the federal loans in XXXX. That was held up in a lawsuit and was finally processed 5 years later. I have written to and spoken with reps from Sallie Mae, XXXX, XXXX, and XXXX, and asked for the same type of forgiveness to no avail. This is a right per the XXXX. Sallie Mae closed their file, but the loans are still on our credit report. XXXX XXXX took over as a debt collector for XXXX. Those loans are still on our credit report. The MA Atty Gen furnished us with a School Misconduct Discharge Application, which is supposed to aid in getting these loans discharged. Nowhere on this app does it state where to submit it. I have attached applicable information. Please help in getting them to the proper offices to have them processed and removed from our credit reports. Your assistance is appreciated!

Complaint What Happened I have been paying Sallie Mae for months now, last fall in XXXX ( XXXX ) I turned on auto-pay to automatically deduct the bill from my account so I wouldn't have to go out of my way to pay the loan. The following month came around and I began receiving dozens of automated calls at all hours of the day each and every week. The calls were followed by emails and physical mail exclaiming to me that my loans were overdue and had late penalties attached and required immediate attention. Sallie Mae was then called directly to " square '' away the matter. They said to me that they would remove the late fee as the bill was on auto-pay. Literally every single month since this has been exactly the same. They claim that my auto-pay set up is somehow late each and every month and late fees get tacked on every single time despite the bill being AUTOMATICALLY PAID each and every month. They do nothing but harass me on a daily basis about the matters and I'm sick of this and their inability to resolve their own issue. The power they wield affects my credit and I'm sick of them abusing it.

Complaint What Happened This issue all began when SallieMae stopped auto charging my bank account without notifying me. At this point in time, I was diligently making on-time payments ( while in school as they wouldn't allow me deferment ) so I did not realize that the company stopped charging my account until this happened. When I noticed after two months that SallieMae wasn't charging my account, I called them to discuss this issue. Immediately the response I received was negative. The man I spoke with told me that I was in delinquency for months, despite never receiving notice about it. Additionally, he demanded I pay the full amount or I was to be sent to collections. I told him that I couldn't pay the full amount upfront as it was over {$9000.00}. I told them that I would like to stick to my original payment plan, as I will make the continued payments. He became rude and aggressive and wouldn't listen to me. At this point, my father 's credit was affected and now is horrible as he is my cosigner. I am willing to pay this loan, I just can't pay the full amount. I called several times, but the woman I was speaking to XXXX XXXX ( XXXX ) and at first she told me she would help me with arranging a payment plan, this call was today, XX/XX/23 at XXXX XXXX but I need my father present, at the time he was at physical therapy. I called back at XX/XX/23 XXXX XXXX with my father present and suddenly she told me that I couldn't do the payment plan, and I had to pay {$5000.00}. When we notified her that we couldn't pay that amount on such little notice, she became rude and abrasive and tried to hang up on me without continuing the conversation. This left me feeling dejected and alone in my situation. At this point, I asked for the collection departments number so I can speak to them directly and she wouldn't provide me with any information in regards to them. I am very willing to pay off the amount but I need to do it in monthly increments.

Complaint What Happened A Sallie Mae private loan came up in June 2016 with me as the borrower and my late father as the cosigner. I had no prior knowledge of this loan so I tried to gain as much information about it as I could. I contacted Sallie Mae about three times, trying to get a copy of the promissory note ( with signature ), but I was either ignored or sent the wrong information. Eventually they sent the correct documentation and the information under my name was horribly incorrect. My martial status, place of work, source of income, and homeownership was a copy of my fathers information. It stated that while attending college, I worked full time for 5 years at a XXXX XXXX, made {$100000.00} with additional income from a spouse of {$100000.00} ( which is inaccurate ). It stated that I was also married and owned a home. The only thing else on the loan was an electronic signature, I asked for a copy of a written signature or a signature written with a track pad, but they did n't respond. I was told by my step-mother to see her lawyer ( an elder and estate law firm ) for help and they advised me to continue to pay the loan while they sent a letter. The response from the letter was that because I took advantage of the loan and that they have an electronic signature I was still responsible for the loan. I found out by looking at the paperwork that my father took out this loan in XX/XX/XXXX while being treated for XXXX and died on XX/XX/XXXX. My father listed that I worked at XXXX XXXX in XXXX and that he worked for XXXX XXXX. I was never notified of the existence of this loan and have met my responsibilities with all the student I was obligated to pay. I was never told about the existence of this loan there I am not responsible. As a side note my mother and I called the US Department of Education and was advised to call XXXX to see if the loan was federal or private and it was private loan from Sallie Mae. When we call Sallie Mae and attempted to speak to a representative on this matter, the representative put on hold then came back and abruptly informed us that she could not speak to us any further and to have our lawyer call this number XXXX. When we called it was not in service and referred us to the original Sallie May number.

Complaint What Happened An email sent from Sallie Mae Bank provides evidence that the bank is using the name of the college in the email subject line in order to generate loans. The subject line of the email was " Assumption University 2024 Tuition Information. '' This is a clear violation of Reg. Z section 1026.48 ( a ) that clearly states co-branding is prohibited. If there is an endorsed lender arrangement, there is no statement that the creditors loans are not offered by the educational institution. Further, it is a violation of section 316.3 ( a ) of the CAN-SPAM Act. A reasonable recipient would not interpret the subject line to conclude that the email is a commercial advertisement. Further in the email, in order to apply for a Sallie Mae loan, it is stated that applicants must, " ... provide an unexpired government-issued photo ID. '' However, according to Reg. B, section 1002.5 ( b ), " A creditor shall not inquire about the race, color, religion, national origin, or sex of an applicant or any other person in connection with a credit transaction [ with limited exceptions ]. '' By requiring a photo ID, the bank is ascertaining the race and/or color and/or sex of all student loan applicants. This practice is openly discriminatory, potentially resulting in numerous fair lending violations. Finally, this Sallie Mae Bank email could easily be identified as a XXXX violation. Given the excessively high interest rates offered by Sallie Mae Bank in comparison to other student loan lenders, applicants are lured into applying with Sallie Mae Bank by using the school 's name in their marketing. The " Sallie Mae '' name alone mistakenly leads applicants into believing it is a government student loan with government benefits. As a private loan lender, Sallie Mae Bank should be cited for gross violations like this sent to people that applied for a scholarship on their website. This lure of uninformed consumers to their website for loans that they believe are endorsed by the school is a blatant violation of what Reg. Z, CAN-SPAM, Reg. B, and XXXX are all trying to prevent. I urge you to take action regarding this injustice. Concerned college parent, XXXX XXXX

Complaint What Happened Sallie Mae denies receiving a check payment mailed more than one month ago and has not applied my payment to my account in a timely manner. I refinanced my Sallie Mae student loans into a single loan with another servicer. The payoff checks were mailed to Sallie Mae on XX/XX/2022 directly to their payment address listed on both my statements and their website. Sallie Mae 's website says check payments will be processed in 7-10 days ( screenshot attached ). On XX/XX/XXXX, I called to inquire about the status of my payment. Customer Service claimed they see no record of the payment being processed, or that the check was even received. Since this was 17 days after the check had been mailed, they opened an " investigation '' to find out whether the check had been received, and why it had not been processed if so. I provided check numbers and specific amounts, as well as the address they were sent to. According to my online account, that support ticket was closed one day later on XX/XX/XXXX. I received no update as to the result of the investigation, and there was still no payment posted to my account ( screenshot attached ). I called again on XX/XX/XXXX ( 21 days after the check was mailed ). I was told again there was no update or payment received. There is no record that the check has been received, and they blamed it on USPS being slow. I was told to specifically call back on XX/XX/XXXX and that there should be an update on my payments page by then. There was not. XX/XX/XXXX I called for a third time, ( 28 days after the check was mailed ). I was connected with a much more helpful representative that put me on hold while she reached out to other employees for assistance to look into whether the check was received. After almost an hour, I was told the same thing. There is no record of the check being received, to keep monitoring my online account. I asked about waiving my next payment/late fee as I am now paying two different loan payments for essentially the same loan. I was told that even though there is clearly a record of an investigation and I have been told this is unusual and needs to be looked into, I would need to go through the usual payment hardship/income based repayment options and am not offered any flexibility in the meantime. It is now XX/XX/XXXX ( MORE THAN ONE MONTH AFTER MAILING THE CHECK ) and the payment has not been processed. In this time I have incurred two additional rounds of interest, and have needed to make two more EFT payments. It is completely unacceptable that a process that is advertised to take 7-10 days takes more than one month. These loans are accruing interest ( at around 10 % APR ). If someone was paying their loans by check as their normal payment method, they would be charged late fees, have late payments on their credit report, and not have their payment applied in time before their next statement was issued. This is absurd, and appears as nothing but stringing along payments, denying receipt of checks, and brushing off borrowers so the company can avoid the loans being refinanced while they continue to be paid interest on them. My advice from customer service on what to do if the payment was not posted before my due date, was to not make my loan payment, and hope the checked showed up soon.
