When there is a change in work area conditions or degree of employee exposure or stress that may affect respirator effectiveness, the employer did not reevaluate the continued effectiveness of the respirator: Worksite: When the employer, and his employees, voluntarily wore half-mask elastomeric respirators as protection against dusts and particulates the employer did not adequately evaluate the circumstances under which the respirators would be used. Respirators were worn with the incorrect cartridges used as protection against dusts, and worn with excessive facial hair that would prevent a proper face-to-facepiece seal. |

This was borne out by an employee using a half-mask elastomeric respirator with organic vapor cartridges as protection against particulates. The correct cartridges to use are HEPA cartridges. |

Citation text line | 29 CFR 1910.1200(e)(129 CFR 1910.1200(e)(1): The employer did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met, and which also includes the following: (i): A list of the hazardous chemicals known to be present using a product identifier that is referenced on the appropriate safety data sheet (the list may be compiled for the workplace as a whole or for individual work areas); and, (ii): The methods the employer will use to inform employees of the hazards of non-routine tasks, and the hazards associated with chemicals contained in unlabeled pipes in their work areas. Worksite: When employees were working with, and exposed to, isocyanate-containing foam sealants, the employer did not develop and implement a written hazard communication program that lists the hazardous chemicals to which employees are exposed and describes how the employer will inform employees of the health and safety hazards of chemicals used in any non-routine tasks they may perform. |
