Subject : Formal Complaint Against Credit Acceptance Corporation for Unfair Practices Dear Consumer Financial Protection Bureau, I am writing to file a formal complaint against Credit Acceptance Corporation regarding their persistent and unwarranted communication practices, despite my explicit request for all communications to be conducted in writing.
Details of the Complaint : Background : On XX/XX/XXXX, I requested that Credit Acceptance Corporation cease all phone communications and correspond with me exclusively in writing, as is my right under the Fair Debt Collection Practices Act ( FDCPA ).
Violation : Despite this request, I received a dismissive response from Credit Acceptance Corporation, stating : We are in receipt of your email/request. I am filing this formal complaint against XXXX XXXX XXXX and Credit Acceptance Corporation due to their involvement in deceptive practices, dealership fraud, and predatory lending that have caused financial harm and significant distress. Below are the key issues related to my case : XXXX. Deceptive Loan Terms and Down Payment Misrepresentation I was informed by XXXX XXXX XXXX that I qualified for an auto loan through Credit Acceptance Corporation, but I would need to provide a {$5500.00} down payment to secure the loan. However, after making the down payment, I discovered that a significant portion of this payment was applied to undisclosed service contracts and other charges that were never explained to me during the loan application process. Specifically : - The dealership bundled unspoken contracts, including a XXXX XXXXXXXX XXXXXXXX XXXX contract priced at {$1600.00}, without my prior knowledge or consent.
- Additional registration and miscellaneous charges were added without disclosure, effectively reducing the actual amount of my down payment applied to the vehicle purchase.
XXXX. Forged Documents and Loan Misrepresentation During the loan process, I was shown a virtual contract that I could not view properly or sign. The dealership misrepresented the loan terms, and I suspect that documents may have been forged or altered after the fact. I was not given the opportunity to review or sign a physical contract in person, raising concerns about document integrity and potential forgery.
XXXX. Predatory Lending Practices by Credit Acceptance Corporation Credit Acceptance Corporation financed the vehicle loan for {$22000.00} with excessively high interest rates and predatory terms that were not clearly explained to me. The loan included hidden fees, exorbitant interest rates, and unnecessary add-ons such as the service contract mentioned above. Additionally : - Credit Acceptance has consistently misreported my payment history to credit agencies, damaging my credit score.
- I believe Credit Acceptance engaged in unethical lending practices by manipulating loan documents and imposing unfair terms that have caused undue financial burden.
XXXX. Violation of Consumer Rights The actions of XXXX XXXX XXXX and Credit Acceptance Corporation constitute violations of my rights as a consumer. These practices reflect a blatant disregard for transparency, honesty, and fair dealing, which are essential in financial transactions. I was misled about the loan terms and subjected to predatory lending that has left me in a difficult financial position.

Legal Action Intent Due to the severity of the fraudulent practices and financial harm Ive endured, I am in the process of pursuing legal action against both XXXX XXXX XXXX and Credit Acceptance Corporation for their deceptive and unethical behavior. 15 USC 1662- Credit Acceptance required a down payment of {$3000.00} when this law states that no advertisement to aid, promote, or assist directly or indirectly any extension of consumer credit may state ( 2 ) that a specified downpayment is required in connection with any extension of consumer credit, unless the creditor usually and customarily arranges down payments in that amount.

d DEANCO to provide me with copies of the legal notices sent and proof of the commercially reasonable manner of the notification and notice of resale of the subject vehicle for my records. They failed to investigate this account properly, proof this repossession was made lawfully and all the legal notices required after I sent letters to them and they neglect has violated my rights to have an accurate credit history and hurting my ability to be accepted for new credit.

On XX/XX/year> I purchased a used vehicle from XXXX auto with a loan from credit acceptance, what I did not know was that Credit acceptance was misrepresenting the cost of credit and tricking me into a high-cost loan on a used car. The true cost of credit offered is far higher than what I was told.
Causing me to face unaffordable monthly payments, vehicle repossessions, and debt collection. Credit Acceptance violated consumer and investor protection laws.The company created financial incentives and added extra products to the loan. Credit acceptance is also reporting false information to the credit bureaus regarding on time payments, how much payed off on the loan all just to damage my credit score just for their fair gain. All in all, Credit Acceptance hides costs in loan agreements and sets consumers up to fail.

RE : VIN # XXXX This is simply a request for information in regards to the XXXX XXXX XXXX. I bought this vehicle on or around XX/XX/XXXX from XXXX XXXX XXXX. I was hoping that you would be able to provide a copy of the following information for my records : Copy of the Retail Installment Contract Copy of the Arbitration Agreement Copy of any other documents you have on file with my signature The accounting for my account reflecting payments, credits, and adjustments A clarifying statement of your role in this transaction Also, the vehicle in question was purchased on XX/XX/XXXX, financed by CREDIT ACCEPTANCE CORPORATION repossessed in the state of RHODE ISLAND. Under the laws of RHODE ISLAND and UCC 9-506 as well as RHODE ISLAND XXXX and XXXX statuses, a deficiency can not be claimed unless all of the required notices were properly and timely given, and all of the allowable redemption and cure time limits have adhered too. I demand proof that the repossession of the subject vehicle was legal in accordance with the following UCC : 9-506. Effect of errors or omissions 9-611. The company is violating my privacy by reporting late payments to the credit bureaus. In XXXX I submitted a complaint to the company about the vehicle, I have drove this vehicle a handful of times. The transmission went 3 times and then the engine. I no longer have their vehicle as it was junked. I never signed MY SIGNATURE on any documents! I have tried to contact the company several times to remove any late payments and lower the amount but instead the only care about adding on fees and charging more money on to the loan. A car that was worth XXXX is now up to XXXX. During XXXX the CARES ACT was provided no company was to report or add on to bills and this company was still adding on late fees and reporting late payments to the credit bureaus when I was not even working and sick. Ive tried to come to SEVERAL AGREEMENTS with the company and so they care about is the vehicle! Im ready to take legal action now because now this has been over 6 years and still adding interest and I have been trying to make payments and yet they do NOTHING to work with people!!!!! I will no longer pay and I will have my attorney fix it unless they are willing to send in to the credit bureaus a letter to fix late payments!!!

XXXX XXXX XXXX Wed, XXXX XXXX, XXXX AM ( XXXX hours ago ) to antitrust I was advised to contact you regarding the above car loan corporation.
On XX/XX/XXXX I was diagnosed with XXXX, the Rhode Island Department XXXX XXXX placed me on a XXXX quarantine, I did not get better until the end of XX/XX/XXXX. I contacted Credit acceptance, since I owed only XXXX on my car. I paid XXXX dollars for a XXXX XXXX XXXX.
After all was said I paid Credit Acceptance XXXX dollars, My car was repossessed on XX/XX/XXXX. I was told I had to pay XXXX too get my car back. They also added several fees that brought what I owed to {$1300.00}. I worked hard to keep the car. It was the first one I financed. They HAVE SINCE AUCTIONED MY CAR. I now have no vehicle and they are stating I owe them money.
Due to covid I lost my job, i lost my car and i was brought to my knees. If you want the car paid for I need to work to do that. I have contacted the attorney general, the XXXX, the house XXXX XXXX, the XXXX for XXXX in Rhode Island.
Please I need help, This was so unfair on their part. They were rude, demanding, and basically told me to bad. They are not required by law to follow any of the governments or the XXXX of Rhode Island 's laws regarding covid.
