Citation text line 29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) of this section, whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level (TWA) of 85 decibels measured on the A scale (slow response) or, equivalently, a dose of fifty percent. For purposes of the hearing conservation program, employee noise exposures shall be computed in accordance with appendix A and Table G-16a, and without regard to any attenuation provided by the use of personal protective equipment: 1) On 03/19/2015 an employee (Grinder) grinding silica-containing slag and debris off of poured-metal parts was exposed to noise in excess of OSHA's Action Level (AL) of 85 dBA. The employee was exposed to noise at a level of 91.9 decibels for an eight-hour Time Weighted Average (8-hour TWA). This level is 129% of OSHA's Action Level of 85 dBA (considered the 50 percent dose). The employee was sampled for 480 minutes. Zero exposure was assumed for any unsampled time. 2) On 03/19/2015 an employee (Grinder) grinding silica-containing slag and debris off of poured metal parts was exposed to noise in excess of OSHA's Action Level (AL) of 85 dBA. The employee was exposed to noise at a level of 92.2 decibels for an eight-hour Time Weighted Average (8-hour TWA).
